Uncertainty of fate has played its hand with Merrick Garland, chief judge of D.C. Circuit Court of Appeals. He will now look over the appeal of President Trump to revoke the judgement of judge, placed in favor of Democrats seeking his (Trump’s) financial records.
Garland’s name was suggested for the Supreme Court by former President Barack Obama in 2016, after the death of Associate Justice Antonin Scalia. But, the Republicans and Senate Majority Leader Mitch McConnell obstructed his nomination, debating that the new and upcoming President should be the one to select a judge for the position at the Supreme Court.
The appeal, which judge Merrick Garland might oversee, is the one in which the Democrats subpoenaed the current President’s accounting firm Mazars USA. The move is considered to look for the statistics of the finances of his businesses.
However, on Monday, Trump filed a motion to revoke the subpoena, which Rep. Elijah Cummings provided at the start of this month. He has asked for all the financial records from the Jan 1 2009. The judge denied the motion to block the subpoena saying that the revelation of finances would ameliorate current ethics and disclosure laws.
Following the denial, Trump’s attorney Jay Sekulow said, “We will be filing a timely notice of appeal to the D.C. Circuit Court of Appeals.”
The subpoena would also help to gain perspective if President Trump cohered to Emoluments Clause of the Constitution. These clauses restrict the President from “cashing in on his presidency”.
The subpoena was issued when Michael Cohen, Trump’s former attorney, disclosed that the President falsified the financial statements to get loans. Cohen provided financial statements of more than three years to the Housing Committee and claimed that Trump under-rated his assets to minimize the taxes on his real estate property.
As there are 17 judges on the appellate court, and the cases are assigned to a panel of three judges, there is a chance that the Chief Judge Merrick Garland might not even get to judge the fate of the appeal.
Reporters like Matthew Miller and Steven Dennis; Zev Karlin-Neumann, a Democratic speechwriter; and Dr. Dena Grayson, former Democratic candidate for US Congress, posted tweets from their respective accounts about the irony of the situation.
While the Trump administration is willing to knock at any door to revoke the Subpoena issue, it certainly is entertaining to see the fate that has brought the Republicans and Merrick Garrland once again face to face with each other. It is believed and claimed by many that Garland won’t be biased, as the Americans look forward towards a fair process.
